Just Between Friends (JBF) – Harrington, Middletown & Dover, DE Operated by Round and Round, LLC
For purposes of this agreement, “JBF” refers to Round and Round, LLC d/b/a Just Between Friends Harrington, Middletown & Dover, DE.
By registering as a VIP consignor and participating in a JBF sales event, I acknowledge and agree to the following terms and conditions.
Pre-paid VIP consignor fees are non-refundable. All fees, consignor payouts, and event policies are established by JBF and are disclosed at the time of registration.
JBF acts solely as a broker for the consignor; ownership and title to all consigned items remain with the consignor until sold, and no payment is owed for items that do not sell.
I am the rightful owner of all items consigned and have full authority to sell them. Consignors may only submit items that are approved and in season according to the JBF Consignor Guide, which is incorporated by reference into this agreement and which I am responsible for reviewing and following prior to drop-off. All items must be clean, complete, seasonally appropriate, in good working condition, compliant with applicable safety laws, not subject to recall, and not counterfeit or altered in any way, including altered labels. I verify that no item is subject to any current, pending, or threatened recall, including those listed by the U.S. Consumer Product Safety Commission (www.cpsc.gov
). Items that do not meet JBF standards or the Consignor Guide may be rejected or removed from the sales floor at any time, and a $1.00 fee will be charged per rejected item. Any item returned due to defect, damage, missing parts, or failure to function properly will result in no payout for that item.
As a VIP consignor, I understand that my items will be tagged by a third-party tagger. I acknowledge that all VIP items will be marked “reduce” and may be discounted during designated discount periods. I further understand that all VIP items are marked DONATE, and any unsold items will be donated to Forget Me Not Families or another designated local charity. VIP consignors do not participate in consignor pick-up.
VIP consignor payout is 40% of gross sales, minus any applicable supply fees. I authorize JBF to pay my tagger 20% of my gross sales, along with any supply fees charged by the tagger, prior to issuing my consignor payout. Consignor checks will be emailed to the email address listed in my JBF profile and issued within 14 days after the sale ends. Consignor account information, including name and email, must exactly match registration and tagging account information to avoid payment issues.
Lost Item Policy: If an item is lost and later sold at a future JBF sale, the proceeds will be included in that sale and applied toward all applicable consignor fees. Payment will only be issued if net earnings for that sale, after all fees, meet or exceed the minimum payout threshold.
I understand that selling items in a public venue involves inherent risk. JBF is not responsible for fire, loss, theft, damage, or missing items and provides no compensation for such items beyond the terms stated in this agreement. I agree to indemnify and hold harmless JBF, its owners, employees, volunteers, and agents from any claims, losses, or damages related to my consigned items.
VIP Consignor & Tagger Disclaimer: I acknowledge that any agreement regarding tagging services exists solely between me and the tagger and that the tagger is an independent third party, not an employee or agent of JBF. JBF’s role is limited to referring taggers and processing payment of agreed tagging fees from my consignor proceeds. JBF does not take possession of, or assume responsibility for, my items while they are in the care or control of a tagger.
I agree to act ethically and understand that I may be asked to sign a confidentiality agreement. I agree not to attempt to learn or use proprietary business practices or operational methods.
By participating in the sale, I grant permission for my image to be used in JBF promotional materials unless I verbally opt out.
By registering and participating as a VIP consignor, I acknowledge that I have read, understand, and agree to all terms and conditions outlined above.
